My boyfriend worked for a company with a union. He asked to have off for his grandmother's funeral and they said ok, and that he will be paid for 3 days off. The funeral was 18 hours away in which we had to drive there and back in 4 days and attend the funeral. He went back to work on the fourth day late (about 11am). He called to tell them we just got home about 4am and that he will be in late. They said ok. When he got there: first, they said they will not pay him for bereavement because grandmothers do not count and second, they sent him home because they do not let people punch in for the day after 11am (which he was not told). Keep in mind he was never written up for anything or given any verbal warnings.
A few weeks later he had called out sick. He was told to bring in a doctor's note and he will be ok. He was out 2 days but went to the docotrs and got the note. When he got to work the next day, they told him that is not acceptable and to go home, he was "suspended until further notice". Everyweek that went by he called his job several times a week...the person he had to talk to was not there, they will have him call him when he gets in......they still have to talk to upper management...every excuse they could come up with they told him. Finally, about 3-4 weeks later, he got in touch with someone and he was told that he had been terminated and that they sent the "pink slip" to his house weeks ago (which he never received). Thoughout all this he called the union reps and they told him to call them back when they talk to someone.
First question: is the union wrong for not helping...isn't that what they are supposed to do in situations like this...help the members...besides they are paying the union every week?
Second Question: was he unlawfully terminated being that he was never verbally warned or written up. Being that they would tell him one thing and he would do it and then go to work to be told something different. Then terminating him without giving him a "pink slip" or formally telling him?
Please help, because he feels like they did him dirty and all he was doing was going by what they said to do every time. Anything would help...Thank you very much.
