View Full Version : Pulled over by off-duty officer after cutting him off

I pulled out of a driveway and did not see any cars coming. As soon as I pulled out I saw 2 bright lights in my rear view mirror. The car, actually, SUV, was right on top of my car. The driver started honking his horn repeatedly and continuously flashed his brights. I sped up to the speed limit but he stayed right on me honking and flashing. This continued for 2 1/2 blocks. Finally, I decided to tap on my break to get him to back off. He did and backed up. A few seconds later, for no apparent reason, he continued his attack. Another 2 blocks of the same and I hit the breaks hard and was going to pull over to let him go by. He maneuvered around me and opened his passenger window. He was in uniform and yelled for me to pull over. I didn't know what to think of it so I slowed down and he drove in front of me and pinned me in with his SUV. He got out of his car yelling at me telling me that I tried to make him crash and he was going to put 6 points worth of tickets on my license. I told him that he was flashing me, tail gating and harassing me with his vehicle and that it was an accident that I cut him off because I did not see him. He did not care about any of this. He looked down and saw my PBA card in my wallet and told me to give it to him. He crumbled it up a few inches from my face and told me that he had 48 hours to decide if he was going to ticket me. He got back in his car and I left.

I feel like I should report this officer. He is from my town. Any suggestions about this situation? I feel that he abused his authority while off-duty.

I would file a complaint against him in municipal court for harrassment, careless driving, assault and destruction of your personal property (your PBA card). Turn the tables on him and file your charges first. Then, after the municiapl court is over you can file a civial lawsuitin Superior Court for harrassment, intentional infliction of emotional distress, assault and destruction of your personal property. Don't let up and make this SOB pay.

Anyway, this event took place a week and a half ago. I havent heard anything from the police department. The officer that gave me the PBA card said that the guy just tried to scare me and that if he truly wanted to ticket me would have called for someone on duty to write the tickets.

My only concern is that my town is really big on racial profiling due to a neighboring town that is slowly going down hill. I dont want to get caught in a situation where I end up getting harassed on a regular basis. As it is I have been pulled over 3 times for no reason other than "my car fit the profile of a car they are looking for".

Most raffic offenses have a 30 day statute of limitations. So you can file a complaint(s) against the cop on the 30th day right before the clerks office closes. This way the cop will not be able to issue you a ticket in retaliation. Also, if the cop later tries to harrass you for bringing charges against him you can then sue him and the police department for civil right violations.
