View Full Version : SNOW STORM CLEAN UP-WHO IS RESPONSIBLE?

* My next door neighbor has a large tree who's trunks and branches
overhand my property. Yesterday's snow storm and the heavy snow
bought two large trunk branches down into my yard.
They are resting on a 45 degree angle from the ground in my yard
to his tree in his yard..(the trunks did not break away from the tree)

Who's responsibility is it to clear the fallen tree trunks?

It the law on this on a town by town basis or a standard law in NJ?

It is your next door neighbors responsibility to clean up the branches. If he doesn't respond in a reasonable amount of time, notify your homeowners insurance. They will most likely pay the claim for you to clean the area up and then they will sue your next door neighbor for there money back.

If the branches in your yard are still attached to the tree in your neighbors yard, it is illegal for you to cut the branches from his tree. Charges you could be hit with are Criminal Mischief and Trespass and if the tree dies, it could cost you thousands of dollars. So just don't go and cut his branches from his tree.

99% of cases like yours work out very well when you have a talk with the neighbor.
