View Full Version : Landlord withholding security deposit

Hello, I stayed at a cottage in South Jersey for a week, and the security deposit was 250ish.

Now, when I arrived for the first night of stay, all i was given was a combo of a lock that contained a key to the house (mind you this is a cottage in the back of a house(i was renting the cottage not the house)).. now it was 3 am when we arrived, so it was very dark... The lock was tricky to understand and i was thusly locked out. After failed attempts to call the landlord for help, i noticed a similar lockbox with some differences on the main house. I tryed the combo and after fighting it for a while it opened and revealed a key to the main house not the cottage we rented. Since it was 3 am we slept in the main house and waited till morning to try calling again.

In the morning we cleaned up and made it look like we werent there at all, returned everything to the condition it was in when we got there. A woman claiming to be our landlords relative was there and helped us out. She got into the lockbox for the cottage key and checked the main house for a mess and verbally dismissed us from any liability (heresay.. great..) about the house, it was clean (she did a walk through, took the keys from us, and relocked the doors)...

anyway we continued our rental period out with no problems and before I left on the last day I took a complete walkthrough video of the cottage to show the condition we were leaving it in.. (i got a new camera in the middle of the week so couldnt do this for the house)... now the landlord is trying to withhold the security deposit saying since we stayed a night in the main house that we should pay one night of rent, which is like 6 times the price... that formally we never agreed to and i think is ludacris (1) and also a 150$ cleaning fee...

1. There was no one in the house so it wasnt even being rented...

Is this a case of some guy whose not getting the full value of his rentable properties so he's trying to rake in as much money as he can?

Also great! hes a lawyer.. cant wait for court Q.Q any help would be appreciated to steps i can take/look forward to expect if a court appearance is possible..
