Ok, here is what you can do to beat a speeding or other traffic ticket in New Jersey. Actually, you are not walking away scot-free, you are lessening the severity of the situation especially if you cannot afford the extra points on your license.
The trick lies in NJ State Statute 39:4-97.2 (Unsafe Driving) which carries a fine of $250. You will also have to pay court costs which are usually around $30.
Ok, so this is what you can do:
1. Go to court on you scheduled day and show up early.
2. Ask the court clerk how & where you can speak to the prosecutor. Some courts have a sign-up sheet for this purpose.
3. Sit and wait until you are called or wait on the line to see the prosecutor.
By the way, it doesn’t hurt to dress extra nice when going to court.
4. When you finally get to speak to the Prosecutor, tell him you want to plead guilty to Unsafe Driving (39:4-97.2) rather than your speeding (or other traffic ticket). Be polite & respectful. As long as you don’t have a horrendous driving record and you haven’t plead guilty to 39:4-97.2 more than once within the past 5 years than the prosecutor should accept the deal.
5. When the Judge calls your name and you go before him he will most likely accept the deal. Make sure you have the money to pay the fine.
The whole point of this exercise is to avoid the points you will get with most moving violations (points on your license may cost you mucho dollars in the future). Your fine will be much higher under this arrangement. I think a 2 point speeding ticket is only around a $100 fine. However, many insurance companies will boost your premium by $150 per point for 3 years. And I think the State can sock you with yearly surcharges for each year you have 6 or more point on your license. (please correct me if these figures are inaccurate)
