We are expecting the letter from the court to be given to the constable to serve any day now. This letter will give the tenant 3 days to get out.
Can the tenant still then pay the rent or can I still have her locked out.
I really think they have no intentions of going anywhere. I do not think they are packing and they keep grocery shopping like they are not going anywhere. What can she do in those 3 days. Do I have to accept the rent if she wants to pay it. I do not want her here anymore. She will just do this again and next time I wont get my money.
A court order is a court order. You do not have to accept the rent, if you do you are giving her permission to stay on the premises and you will have to pay fees and wait the 30 days all over again. The only way the judgement can be stopped is through a court order or other written agreement signed by the landlord and the tenant

Thank you. I really do not want her rent now. Its now the 11th of the month and she is over 3 months late and I want her out. When the constable comes I want her gone in 3 days or locked out

The constable served her gave her 3 days. She went down the the court on Friday got a stay until August 24. This is unreal. They even admitted she is in the system and has done this before. The constable said he served her about 3 or 4 times. Can you imagine. The court should have never given her an extension. Just like tough love. Live and learn. This system stinks never mind the money lost in rent and the fees for court

Just wait it out. This tenant is the type who will sue you if you even approach her. Don't talk to her.

Thanks Eagle. We are trying. WE have filed the paper work to begin suing her for the back rent and everything she never paid. We never got the security she promised when moving in. We allowed her to come in two weeks early with the promise she would pay the security on the first. Not only did she not pay the security she never paid the full rent since she came here in November. She gave us $75 less every month then just stopped paying in June.
We are hoping to be able to get her pension check garnished. She makes a nice little sum between pension, SS and now getting unemployment. She is a good liar I must admit. Even lied to unemployment and won.
The lies on the paper she filed last week to stay until the 24th is unreal. The worst of it is this county has her in their system multiple times. Would you not think they would quit giving her extensions knowing full well she is screwing landlords. She quit her job because she was getting her pay garnished from another landlord. Then she got unemployment. Can you imagine?

Ok, once she is gone you can then sue her for fraud, any damage to the property and any money she owes you. You can go after her like a blood hound but wait until she is gone.
