View Full Version : NJ Motorcycle Lemon Law Question.

Going to try to keep this brief and to the point.

I bought an 08 Buell 1125R motorcycle Brand new from Brian's HD in Langhorne PA. Purchase date was 10/14/09. At the time of purchase I got 3 yr Extended, GAP, and Rim & Tire warranties. I took delivery of the vehicle and as I was doing the walk around I noticed that a turn signal was out. Sales guy replaced it on the spot, within a week I was back because the bike was Backfiring, and decel popping. Service flashed the ECM and sent me on my way. Shortly after that I was back for an Oil light, and Engine light. After that a Service now light, After that an AT sensor, and so on...

I have had nothing but problems with the bike. It has spent more then 72 days in the service dept. And is still not running properly. Current issues are that it gets so extremely hot that I suffered 2nd degree burns on high thigh area of my right leg that comes in contact with the frame of the bike. Also, the bike randomly stalls while riding it. The fairing has melted and warped due to the heat. The AT sensor Failed, The clutch failed, The aftermarket decals that Brian's HD had installed before putting the bike in the showroom have blistered and pealed due to the heat. etc.

I've been very patient with the Dealership and the MoCo to get these issues resolved but have not had any luck. At this point the bike sits in front of my house with 700 miles on it, most of which were put on it by the service dept at Brian's. Brian's has gone to the extent of bringing in a Buell Specialist who claims to have checked out my bike and that it was fine and to come get it. And that the problems I'm having are my riding style and I should go take lessons. Only to find that when I got their the bike was not fine, that the clutch had actually failed and I had to wait on parts. The service manager had no idea that the Buell Tech had even rode my bike. He put 25 miles on the bike even though their was a tag on my bike that said DO NOT RIDE. At this point I called 1-800-, and retained a lawyer:

I've made 2 payments on this bike since I retained the lawyer. And it's eating me up that i'm paying for this thing when I can't ride it. Now the dealership wants me to bring it back to them again so they can double all the heat tape they already put on the frame and fairings. I called my lawyer to ask if I have to bring the bike in for this bandaide because I really don't feel comfortable riding it their with it stalling out and over heating. His paralegal says I should do whatever I can to get the bike to them again. So I'll figure that out...

But my main question is, How long does something like this normally take to get resolved once a lawyer gets involved? I've heard 6 weeks, 6 months, and 2 years... Any advice or information would be greatly appreciated in this matter.

Mike, not to be a jerk or anything but this is one reason I buy Japanese. What I hate worse then sending my money overseas is spending my hard earned money on crap. I'm sorry but I think HD products are all hype and all your spending your money on is a name. There bikes are old technology. Everyone I know with a HD/Buell have nothing but problems and are constantly at the HD dealer. They knock me for buying a Yamaha but I'm the one riding on the weekends while there browsing around the HD dealer looking at motorcycles and gear while there waiting for there bike to get out of service.

Anyway, I know this thread is kind of old, how did you make out?

Agree 100%. Even the technology and engineering of a 1990's Honda Nighthawk 750 is superior to anything Harley makes.

Still waiting, From what the lawyer says HD has until December 6th to respond to the claim. I have an APPT Dec 2nd to have the lawyers technician look at the bike. What pissed me off this month is I had to Register the bike and re-new the insurance.

That's because back in 1990 Honda was still ahead of Harley by 30 years of technology, can you imagine what a 2011 Honda brings?

Mike, make sure you come back here and post an update for us. If you really don't feel safe riding the motorcycle then ask them if they will pay for a tow and if they deem the motorcycle safe then you will ride it back home (weather permitting) or arrange for an inspection at your garaging location.
