Hello fellow posters, so I am a 20 year old male who lives in New Jersey with no previous infractions with the law; on May 29 I purchased alcohol with my brother's valid ID (he has another one as he thought he lost the one I had). While I was driving with my other 20 year old friend, I came across a DWI random checkpoint and was caught as I had the two 40 ounces and a 12 pack of beers in the back seat of my car. Following this, we were taken to the police station to proceed with the booking process. I told the cop that I bought the alcohol with my brother's ID (dumb mistake), since it was in my wallet which they were rummaging through. Since I was cooperating with them, they decided not to charge me for false identity, but the cop said the sergeant found out about the ID and took it (although I still wasn't charged for the ID). So, I was just charged with underage possession of alcohol. I wasn't drunk and did not have any drugs in my car, so that was what they proceeded to do.

Now, my question pertains to how I will present the case during the arraignment in July. I now have a lawyer; should I present the case with the lawyer that I purchased the alcohol from a pedestrian in the town I bought it from, or should I proceed with telling them that I bought the alcohol with my brother's ID ? My friend told them the former, but I told them the latter. Would you think they would present the ID in court, and if I were to tell them the story about obtaining the alcohol from the pedestrian, is that a possible perjury offense ?

If I were to tell them the truth, which is what I told the cop, could the DA charge me with false identity, even though I was not charged with that on the police report ?

Lastly, would this be eligible for Pre-Trial Intervention, as I have never committed a prior offense ? I still have about 1.5 weeks to utilize that resource as from what I've read it can only be used 28 days after the indictment.

Sorry about all the questions, but any of them answered would be greatly appreciated.
