My 20 year old son was attacked from behind by a 16 year old who punched him in the face, knocked him down to continue punching him, stole his iPhone, then punched him a few more times before being chased off. He was caught and charged with aggravated assault, robbery and possession of marijuana. My son ended up with 3 facial fractures and numerous bruising and a black eye.

We just heard that he's being offered a plea bargain ....if he pleads guilty to robbery, he'll be put on 2 years probation and given community service, a social evaluation and curfew, restraining order, etc.

This is all new to us, so I'm not sure what to make of this. If he accepts this plea and he admits he's guilty, he gets off with probation? The aggravated assault doesn't count for anything? That doesn't seem right to me, but it doesn't look as if we get to agree to that or not? Anyone have any thoughts on how this works? Thanks!!

You should write a letter to the prosecutor and tell him/her that you would be very unhappy with a deal like this. You may also want to sue the attacker in a civil suit for money damages.
