View Full Version : CHILD'S RIGHTS - HELP!

How old does a child have to be before they can state what they wish for visitation and will their schedule impact a younger sibling?

I am the mother of two (boy 12; girl 9). My ex gets them two overnights a week and alternate weekends. He has already had a charge of neglect by DYFS substantiated and ordered by the judge to atttend parenting classes. I have a permanent OR and he has constantly been caught doing things for which he simply gets chasticed. At first the judge had the children going for visitation separately. When he had them go together it was because in order to prove a point, when my ex asked for more time in order to diminish the child support, the judge got angry and gave him more time, but denied him the change in support. The children always had a hard time visiting, but now more so because of the DYFS incident. If my son says he doesn't want weekly overnights, will they still make my little one go?

I would appreciate any information anyone could give me. I always thought my judge was somewhat fair, but my ex gets away with everything. I don't want revenge, I just want what's right for the kids.
