View Full Version : need to ask tenent to leave

My father recently passed away. I live in his house with him but own another property. Financially it makes no sense to keep both homes, and the other house is only 3 miles from my job instead of 33 miles. I have a tenent at my other property who moved in last August, a neighbor from down the the block who was looking for a larger place and who's family has been on the same block for over 50 years. I gave her a lease that she never signed, and I never asked for it back since she has a connection to the neighborhood and let it go. I also gave her a reduced rent ( -$150 )from what I was asking for because she said that was the max she could afford and I thought about the fact that she was going to be reliable and long term tenent vs. finding a stranger that I could have problems with in the future. Not less than 3 weeks after she moved in, she moves her boyfriend in and I feel that she has totally taken advantage of me. She has sworn to me that he only visits, but I see him there at all different times and when I first saw him outside the house sitting on the stairs, I asked him " can I help you", and he said he lives here. She claims he misspoke. All this being said, I now need to ask her to leave so I can move in, and I think she will think it is for other reasons than the fact that I need a place to live. How much notice do I need to give and the fact that she may have that original lease that was never signed by either of us come into play. Do I need to send a certified letter to her? Should I have my attorney send it?
