My wife was sitting at a red light today 03/19/2010 at 9:45 AM when a young guy rear-ended her. My wife told the cop she was sitting at the red light when the car behind her rear-ended her. The driver of the other car told the officer that he tried to stop in time but there was grease on brake peddle and that is why he rear-ended my wife.
I'm sure that the report and insurance company will find the other driver 100% at fault, but I would like to know if my wife and my mother-in-law whom was a passenger in the car are entitled to any damages?
I have zero threshold on my policy.
As of late tonight my wife and mother-in-law both have neck pain and headaches.
Damage to my car was minimal. There is heavy scratches and two hole/indentations in the rear bumper cover that were left from the other cars front license plate screws. My car isn't going to be seen from the affiliated auto body shop that my insurance company wants me to bring the car to till Tuesday the 23 rd. So I won't know if there is any internal damage to the styrofoam and bumper pads that lay under the bumper cover. I bring this up because from the looks of the damage to the car, you wouldn't believe anyone had really gotten too hurt. Nonetheless my wife is in pain and I'm sure she wouldn't lie to me about that.
