View Full Version : company planned picknick goes wrong when workers do something neglegient at party

just last week in new jersey i attended a work funtion during working hours. it was held at a country club and all the company ceo and staff attended. there was plenty of food and alcohol involved.
during this time the annual tug of war event was going to start. both teams were chosen and the tug started.
team A won the first round
team b won the second roud
then the best of three started


team A conspired to drop the rope at a given time .
the pull started and at the given time team A dropped the rope and watched the other team fall on their asses,....(funny huh0

WELL TEAM B HAD A WOMEN WHO FELL ONTO HER HEAD AND RECIEVED A CONCUSSION. SHE HAS NOT BEEN THE SAME EVER SINCE...

this was my wifes incident, she recieved some work comp from the insurance company(we did get a lawyer for this) she end up losingher job due to not able to go to work.
this incident happened oct 2009 and it has been almost one year since she have been at work. she required pt, strong meds due to a spinal injury.

to this day i still believe she has a strong case but since this happened at a off site but on comp time no lawyer wants to touch it because it will be very time consumming.
any takers on this and some advise????

The injured person may have a third party claim against those who "dropped the rope" as that act could be construed as negligence. There are many other issues here and the injured party needs to see a workers comp/personal injury lawyer to sort everything out. By the way, having alcohol at a company function in todays world is just plain stupid.

So how is your case going along?

I remember two workers compensation claims that didn't turn out so well.

One was a armed guard in his 20's that was in the back of an armored car that was broad sided at an intersection. He had two herniated disc and the judge told him to basically go pound salt. Really, he got nothing.

The second was a man in his 50's. I can't remember exactly what happen to him but I do remember that he had plates and screws in his back and had to wear special shoes for the rest of his life along with walking with a cane. Along with 100% disability he received less then $100.000.

I myself had a tank fall on my knee and rip the bursa, the patella tendon and the quadriceps muscle open. The repair required surgery to repair and I was out of work for 6 months and then another 3 more months of light duty work all while going to PT for the 9 months. Workers compensation gave me a 5% disability and a whopping $7,000.

When you sue WC it is hard to know what your going to receive for damages.
