I have rented out an attic which shares the electricity with the apartment right below ...electricity
had been cut out because the electricity bill had not been paid. I have already paid out my monthly rent and deposit 1st of june. Utilities were to be included on my rent money so landord cannot charge me extra. What should I do, can I request all my moneys back and vacate the apartment?

Did you sign a lease and if so was electricity mentioned in it as part of the rent?

In any case, if the landlord does not fix the problem asap you could probably get out of the lease (and have all monies returned) because the landlord breached the "implied warranty of habitability" which imposes a duty on the landlord to keep the premises habitable. You really cannot live in a place with no electricity.

The rental was month to month rent with one month in advance to vacate apartment, no year lease of any sort , however I do not have any document stating such agreement since it was done per conversation mutual agreement. Can cell text messaging be used in small claims court as evidence?

You rent an attic? Is this a legal apartment?
