My employer have filed a contract dispute case against me under special civil part. I had signed a contract with the employer stating that I will owe them $5000 if I resign from the company within 18 months of employment start date. However I have never submitted a resignation letter from my part. I had to travel outside the country for a personal emergency and have indcated the employer about the same at the earliest opportunity I had. I have also indicated my full intend to return to work at the earliest time possible.
I am planning to answer the case within the 35 day period. But in order for me to go for visa stamping and re enter the country again, my employer need to provide me complete documents like pay slips, project details etc which they are not providing. So once I receive the trial date how will I enter the country to represent myself. Also that will cause me a travel expense of $4000. I am currently unemployed and is in a very difficult financial situation and will not be able to afford a lawyer or travel expense. Is there anyway I can avoid being present at the court due to the special circumstances? Also my eployer have filed a case against my spouse for contract dispute, while he have not signed any contract with them! They have also purposefully sent the notice to my oldest address,even though they had the latest and my last address in US, in order to purposefully delay the receipt of notice as it had to be redirected 4 times!
Any quick advice is really appreciated as they have already delayed the receipt of notice and time is running out before the 35 days response deadline, after which the case will be ruled in favor of them if I do not respond.
