I HAVE A TENENT WHO HAS A MONTH-TO-MONTH TENANCY. THEY HAVE NOT PAID THE PAST 2 MONTHS AND I TOLD THEM TODAY THAT THEY NEED TO MOVE OUT BY 5/25. I SENT A CERTIFIED LETTER TODAY ALSO. I WAS TOLD THAT THEY ARE NOT MOVING AND IF I WANT THEM OUT I NEED TO GIVE THEM $25,000. ( I THINK THAT IS CALLED EXTORTION) ARE THEY ON CRACK? AFTER THEY RECEIVE THE LETTER, WHAT DO I NEED TO DO SO THAT I CAN FIND A TENENT TO MOVE IN THE APARTMENT BY JUNE 1ST? IF THEY DON'T MOVE BY 5/25, HOW LONG DOES THE COURT PROCESS TAKE?

Well, you have to give notice which you did. Then you have to file a complaint at your county court house. Each county has a landlord/tenant court which is part of the Special Civil court. I have attached a file which discusses how to do an eviction in NJ. It is in PDF format. This should answr most of your questions. Also, if you visit your county court they usually have forms and instructions on how the eviction process works.
Once you get your judgement for possession you can have the sheriff remove the tenant.

Thank you for your help. I have another question for you. The apartment was totally rehabbed and everything is brand new. If any damages are done out of spite, can I collect money for the repairs? I do not have a security deposit.....it's a long story...MLW
