Seems like one great forum. We have a month to month tennant. We need to sell the home. Need to know the proper procedure for terminating the lease. Our tenant hasn't paid the rent on time in a year and a half. Any help appreciated.

Give the tenant at least 30 days written notice. You should explain that you are selling the house so he understands. Put this in the written notice too. By the way, is this a 2 family house?

Single family. We did file in February to have the tenant evicted for late payments buy they went in and paid the back rent to the court. We just need to get them out, sell the home and move on.
