my children and myself moved in with my boyfriend, It was a rental property , his name was on lease and landlord approved the move.
several months later he moved out , I stayed in the house, I had thought the rent was being paid since I was being told it was, then a month ago landlord took ex bf to court for non payment of rent,(the landlord refused to recognize me as tenant , refused to take my money etc )BF said he took care of it before court but 2 weeks later I got an warrant for removal. I went to court to ask for orderely removal, but since my name is not on warrant of course couldnt grant that, , so out of concern for my children the judge granted a stay pending a further hearing, saying I am an unserved tenant , because whether LL likes it not the court recognizes my tenancy. Regardless ex bf owes 2 months rent I would like to stay in house and continue to pay rent myself. Not sure if thats an option at this point I am sure LL is going to be pretty unnerved to get the court paper from my hearing in his mailbox...any ideas or advice on what to tell judge ? I am going to show just cause, so paper says!
