View Full Version : Help! How to get my deposit back?

Last year I leased a house with 4 other people.
This year, they stayed, and I moved out. No one else moved into my place.
I have not gotten my security deposit back from the landlord, and can't get ahold of her. I saw something on the internet that I don't get my deposit till everyone moves out. Is that true?
Should I contact my old roomates about getting it from them? Cause who knows when they will all move out...
Any help would be appreciated

Was everyones name on the lease or just your name?

Everyone's name was on the lease.

Is your name still on the lease? Or was your name taken off the lease when you left?

Trying to find out from one of my previous roomates, but I assume it is not.
The lease ended, and I left. I did not sign any new lease for this year. I also sent the landlord a letter saying I was leaving months in advance.

Ok, if the lease ended and you did not renew and you are not named on the new lease then the landlord, by law, had to return your security deposit within 30 days. I am assuming that the lease indicated a security deposit was received from each person. If you still have a copy of the lease you should read it carefully.
Assuming that the landlord wrongfully did not return your deposit then you can sue her in small claims court and receive double the security deposit as damages. It is easy to go to small claims court and you should call the county court where you resided and speak to the small cliams division. Explain your situation and they will tell you what to do. They will give you the forms to fill out.
