We been having a problem with our downstairs neighbors since the day we moved into our Apt. The lady who lives downstairs is constantly complaining that were making all kinds of loud noise at all hours of the night and playing loud heavy metal music. For the record I was 5 months pregnant when we moved in, I am the last person who is going to put up with loud noise when im trying to sleep. She had filed 2 complaints with the complex probably a 3rd on the way. Left 2 notes on our doors and come up and knocked on our door a bunch of times. The second time we got a notice from the complex, saying we were making loud noise and playing loud music was for the night i was admitted to the hospital to have my baby. We have a roommate but he went out to the bar and wasn't home during the hours listed on the notice. Even when he did get home he went to bed. I made sure the complex saw my discharge papers showing I was in the hospital. Anyway yesterday we received a note on our door saying we were dragging stuff around at 3am. WHAT!? we were sleeping at 3 am. Anyway the complex wants me to write them a letter saying we feel like were being harassed, then they can do something about it. When i write to them should I go into detail about everything? Or just make it short and just a general outline?

The complex is in tough position because they have a legal obligation to provide habitable premises to you and the downstairs tenant. This means that they have to provide premises without excessive and unreasonable noise. If downstairs tenant documents her complaints to the complex owner then she can legally withhold rent from the owner and maybe even sue the complex owner. Then the owner may have to evict you or move you to another apartment. So it is the complex owner that may have the biggest problem here.

When you write the letter to the complex owner you should detail everything especially the times when the downstairs tenant disturbed your peace by knocking on your door. Also, if there is any threatening language in the letters she left on your door then document it too.

From what you describe it seems that this downstairs tenant can be a real trouble maker.

I had the same problem maybe 10 years ago. I was with a woman in her condo and things were very quiet and the older woman downstairs called the police with a noise complaint. It turned out that the woman downstairs was unstable and didn’t like it when the younger women upstairs bought home men. This happen twice and the second time the police wrote a ticket to the women on the 2nd floor. The case was dismissed mostly because the downstairs woman did not present herself well to the court. But the real question is what is too loud. Is there a decibel level that has to be reached and wouldn’t the police have to measure it? I remember when I was a teenager too loud for me was a lot different then it was for my parents.
