My husband paid $100.00 a week in child support. He was laid off from his job with the city. Six weeks later he got the same job with the county (thankfully) but he is making $8,000 less a year in wages. Yes, for the same exact job! He went to court for a C/S reduction , and they lowered the payment by $4.00. I couldn't believe that !! (I am a stay at home mom with 1 small child, but they would not take that into consideration.) Because of the arrears that built up in between jobs they added another $10.00 a week until the arrears are paid. I can't understand how they figure out the amount you have to pay. If he couldn't afford to pay the amount in the first place and went for a reduction, in the end he is paying more anyway. This support is being paid for a 23 yr. old son that he has never seen on a regular basis since he got divorced when he was 13. He was told by the judge that it is up to the child whether he chooses to visit his father or not. At this point he hasn't seen his son in over 3 yrs, and we live in the same town. Also because he didn't carefully read his divorce papers before he signed them, they state that the child is not emancipated "until the child turns eighteen or finishes college, whichever occurs last". So , now that his son is entering into his 5th year of college he will be paying until May of 2009. I think this is so unfair. The ex-wife is remarried, they both have high paying jobs, and she still insists on getting child support for this 'man' aged 23. I just don't get it. Am I being unreasonable? Is there anyway to go back to court and have the divorce papers changed at this point. We are at the point of getting evicted from our apartment, I can't find a job, we got turned down for food stamps, so I did not bother to apply for welfare, my husband had a heart attack from all the stress 5 weeks ago. I can't believe that 2 people who worked so hard all of their lives, and met all their responibilities (between us, we have 7 children altogether) cannot get any financial help in the state of NJ. Any advice would be greatly appreciated. I am at my wits end.

You should read the NJ child support guidelines here:

From what I understand you can go back to court and get the amount changed if your circumstances have changed. But read the guidelines first to learn how everything works. Also, take a close look at Appendix IX-F http://www.judiciary.state.nj.us/csguide/app9f.pdf
