View Full Version : Is my attorney wrong?

I just started working for a landlord in Mercer county. The attorney we use for evictions has told me a couple of things I don't agree with. I am hoping I can get a straight answer here.
- He said I don't need a Registration Statement
- He said he cannot include late and legal fees in the eviction filing even though it is considered additional rent in the lease. He said "Trenton has their own rules"! Now I have to try to explain to tenants why I am charging them more than the amount on the court papers.
- He said that I could charge whatever I want for legal fees regardless of what he charges me.
I hope someone here can clear things up for me. I tried to find the answers online but kept running into dead ends. Also, is there somewhere I can call to find out things like this?

You can call Mercer County Court Special Civil part at 609-571-4484. This is the court that handles all landlord tenant matters in Mercer County. They usually are very helpful.

I believe he is right about not including late and legal fees in the eviction filing. You would have to sue the tenant in another lawsuit after the eviction to recover any damages.
