My deceased ex husband - left his condo (by email - signed 3 times many yrs before he died - no recent signature) to his younger girlfriend - who owns her own condo and did not live permanently with him. My son was executor of the estate - which was only the condo. He spent close to $100,000. taking care of all of my ex's bills etc and defending the Will (for he and his sister) against the GF's (girlfriend) claims that the "email" was a codicil to his Will. The judge decided it was. Now my son is being told by his lawyers he will only receive executor fee reimbursement if the judge approves this??? According to Bergen County Surrogate's Court info I found on line it does not state - at the judges discretion!! The judge in this case was enamored with the GF and considered my kids to be "greedy"!! when they received nothing else from their father - as he had no other assets - he owed money at his death. The condo was the "estate". Is this the case? is my son's reimbursement for all the monies he was forced to lay out to defend this case - to be decided by the judge - instead of being a State Law?? and an automatic entitlement? his lawyer is claiming this now after telling him over the two years of this case that he would receive compensation.
